Chapter Twelfth of the new Military Personnel Law 1442 in Saudi Arabia, in Articles 6 to 53 bis II, regulates the leaves that an individual is entitled to during his military service, and these leaves are:

  • Annual leave, and a number of provisions are related to it, the most important of which are:
    • The annual leave period is 30 days.
    • An individual is entitled to annual leave after 11 months of appointment.
    • Annual leave may be combined to be enjoyed once, provided that it does not exceed 60 days.
    • Annual leave can be enjoyed in periods or on a single period.
    • The Minister has the right to issue a decision to extend annual leaves, provided that the extension does not exceed 15 days.
    • The employer may postpone the individual’s benefit from the annual leave according to work requirements.
  • Field leave: for individuals working in the field or remote places, and its combined period shall not exceed 45 days per year, and shall not be less than 15 days. An individual is not entitled to combine field and annual leave.
  • Occasional leave: Its duration should not exceed ten days during one year and it shall fall at the end of the Hijri year.
  • Exceptional leave: It is granted to the individual at his request, whether inside or outside the Kingdom, and its duration does not exceed 4 months throughout the individual’s service period, without monthly entitlements, and it is obtained only after the exhaustion of his annual leaves.
  • Sick leave: Its duration is within years as follows:
    • Three months with actual salary.
    • Three months at half the actual salary.
    • Three months at a quarter of the actual salary.
    • Six months without pay.
  • Study Examination Leave: It is as long as the period required to perform the academic examinations, provided that proof of admission to the examination and the duration of the examinations are submitted.
  • Study escort leave: This leave is for those who wish to accompany their spouse on scholarship to study abroad or any of their legal dependents.

Reasons for termination of service for military personnel

Article 56 and its amendments of the new Saudi Military Personnel Law 1442 stipulate the reasons that lead to the termination of the service of an individual who is enrolled in any of the military sectors in the Kingdom of Saudi Arabia and subject to the system, and these reasons are as follows:

  • In the case of dispensing with the services of the individual according to the requirements of the work.
  • When referring to retirement, whether early retirement or reaching the age.
  • Expulsion from service based on a military decision issued by the competent authority.
  • Military service for an individual ends when he loses his Saudi nationality.
  • Upon natural death or martyrdom.
  • If the individual stops working without an excuse for seven consecutive days or thirty separate days during the year preceding the issuance of the decision, or if the leave exceeds thirty days.
  • If he has been sentenced to a Sharia punishment or imprisonment in an offense for a period exceeding one year, or has been convicted of a crime related to honor and honesty after a military decision is issued.
  • If the individual is lost during a battle, and 6 months have passed since the date of his loss, if his life is not known from his death, during this period his financial allocations continue to be paid to his family, after which he is considered a martyr according to the military retirement system.
  • If the individual becomes medically unfit for military service.
  • If it is proven that he is medically incapable of performing the work.
  • In the event that a request to terminate the service is submitted to his direct reference and approval of the request.

Duties of military personnel in the personnel service system

  • The military individual is obligated to maintain military disciplines, good conduct and decency, and to set an example for others in these matters.

  • An individual shall refrain from disclosing to anyone other than his superiors or their representatives any military information, or information that came to his knowledge due to the nature of his work, and he must remain secretive about such information even after the end of his military service.
  • A military individual is prohibited from serving in the foreign armed forces after the end of his service period, unless he obtains a permit from the Minister of Defense.
  • A military individual is prohibited from participating in the establishment of institutions or companies, or accepting membership in their boards of directors, or working in them.
  • A military individual is prohibited from directing criticism or blame at the government in any form of media, whether internal or external.
  • It is prohibited to accept any kind of gifts, gratuities or grants, whether they are given directly or indirectly in order to affect his official work.
